Toto and Jake Luchavez were initially charged on Jan 30, 2014. Over a year later, their charges had still not gone to trial. The first 10 months had been consumed in a pretrial motion to quash the charges, which was denied in November 2014. The Luchavez defense filed a motion for reconsideration. In a March 2015 order, the judge denied that as well, concluding:
The informations [charges] filed are valid on its face and there is no showing of manifest error, grave abuse of discretion or prejudice on the part of the investigating prosecutor.
WHEREFORE, the Motion for Reconsideration is DENIED.
